Las Vegas topless club faces trademark challenge

Discreet Gentlemen’s Club, a Las Vegas topless dancing cabaret, has been hit with a lawsuit alleging trademark infringement.

The suit was filed Tuesday in U.S. District Court for Nevada against Michael Saltman and a company called 4636 Wynn Operator LLC.

The suit says Saltman and 4636 Wynn are using the Discreet name without the authorization of the name’s owner, Michael Lathigee.

The club is at 4636 Wynn Road, near Tropicana Avenue and Valley View Boulevard.

Attorneys for Lathigee say in the lawsuit he gained control of the name after loaning cash and "other good and valuable consideration" to a company called Casino Cash Advantage LLC, which needed emergency working capital.

Peter Rinato, a principal of Casino Cash and the former owner and operator of Discreet Gentlemen’s Club, personally guaranteed the Casino Cash Loan, the lawsuit says.

After Rinato and/or Casino Cash defaulted on the note, the default caused the Discreet Gentlemen’s Club name to be transferred to Lathigee, the lawsuit says.

Lathigee has an application pending before the U.S. Patent and Trademark Office for the trademark "Discreet Gentlemen’s Club," the suit says.

The suit alleges the defendants have copied the Discreet Gentlemen’s Club name and are using it on the Internet and in signage on the business.

The suit claims they have misappropriated the name, "thereby causing confusion among the public as to whether the trademark depicted on the Internet or signage is owned or displayed by defendants and whether Lathigee authorized defendants to use the name."

A message for comment was left with Saltman.
