Firefighter Donald Munn Wins Arbitration Against Clark County
Munn Reinstated, Arbitrator Determines “County’s Case Was Built Largely on Speculation”

Las Vegas, NV, May 15, 2012 - Donald Munn, one of two Clark County firefighters fired after an investigation into perceived misuse of sick leave, has won a decision against Clark County. Earlier today, an Arbitrator ordered the County to reinstate Munn to his former position and reimburse him for “any losses in earnings or benefits that he would have received had he not been terminated,” according to the decision. The county was also ordered to reimburse all of the fees and expenses associated with the Arbitrator.

Munn, a firefighter who was hired by the Clark County Fire Department in 1993, was terminated on May 17, 2011 for allegedly misusing sick leave. Of the nearly 20 firefighters that were investigated only two were fired, including Munn who had the second-least amount of sick time of all investigated employees. Following his termination, Munn requested that the union, Local 1908, represent him in arbitration regarding the wrongful termination but the union refused. Consequently, Munn sought private representation from attorney Andrew Rempfer of Cogburn Law Offices and spent his personal funds fighting the County’s illegal termination.

According to the Arbitrator’s award, “the County did not meet its burden of proving that Munn was guilty of the abuse of sick leave and the other violations for which he was terminated.” Additionally, the Arbitrator noted, “There was no showing that the Grievant [Munn] at any time ever exceeded the amount of sick leave to which he was entitled.” Munn, who has a severely disabled son who requires constant supervision and frequent medical attention, often used his sick leave to care for his son and the arbitrator ruled that the, “the county was unable to prove that the sick leave taken by Munn was not used for medical related purposes.” The Arbitrator ruled in favor of Munn and concluded that, “the County’s case was built largely on speculation.”
