Car Buyer Pickets Abusive Dealership
On July 22, 2012, Donna Warren, the purchaser of a 2007 Saturn Vue from Car Country located at 6555 W. Sahara, Las Vegas, NV 89146 will picket the dealership to bring attention to “the brothers” AKA Dave, Rob, James, & Jason - owners / brothers violation of Federal and State Law and sale of “junk” cars.
To protect the buyer, Federal & State Law requires dealers to comply with the Federal Odometer Act.
42 U.S.C. § 1983. Federal odometer law gives the buyer the federal right to certain disclosures, and provides that DMV may not license a vehicle unless there is compliance with those laws.
This is done so the buyer can rely on the odometer reading as an accurate indication of the mileage of the vehicle to determine the condition and value of the vehicle.
In 49 U.S.C. § 32701 Congress found that - Buyers of motor vehicles rely heavily on the odometer reading as an index of the condition and value of a vehicle; buyers are entitled to rely on the odometer reading as an accurate indication of the mileage of the vehicle; an accurate indication of the mileage assist a buyer in deciding on the safety and reliability of the vehicle; and motor vehicles move in, or affect, interstate and foreign commerce.
The purpose of the law is to prohibit tampering with motor vehicle odometers; and to provide safeguards to protect purchasers in the sale of motor vehicles with altered or reset odometers.
Irreparable injury results from violation of the Federal Odometer Act. Consumers rely and are entitled to rely on the odometer reading as an index of the condition and value of a vehicle, and an accurate indication of the mileage assists a buyer in deciding on the safety and reliability of the vehicle.
On June 24th, Car Country failed to prepare the Dealer Report of Sale (DRS); therefore, denying the buyer an opportunity to examine the certificate of title (or a photocopy of the certificate of title); and any power of attorney for the purpose of mileage disclosure that was given to the dealer in connection with the acquisition of the vehicle.
The buyer attempted to resolve this matter with the “brothers” but after admitting on July 17th they had neglected to prepare the DRS on the date of the sale, June 24th, said the DRS was sitting on a desk and that the buyer should come in and sign it.
The buyer refused to violate Federal and State Law by signing a DRS after the fact. Federal and State Law requires the DRS to be signed on the date of sale to provide an opportunity to the buyer to be aware of title and accept the odometer readings as verified by a power of attorney from the prior owner.
“The Brothers” said regardless of the DRS, the deal was final and they would not rescind the sale. Instead the brothers laughed on the phone to the buyer’s representative.
In the meanwhile, the buyer discovered several defects in the car she paid over $9,000 for on June 24th. In addition to worn tires, an independent dealer determined that the car has shoddy shocks and a fuel leak. Nevada is a “no lemon law” state and therefore “the brothers” are protected against selling shoddy cars to buyers. However, “the brothers” are not protected from the Federal Odometer Law. If “the brothers” had complied with the Federal Odometer Law, the buyer may have discovered in the odometer readings and in title reasons why the car was in its shoddy condition.
• Was the odometer rolled back?
• Were there previous mileage disclosures?
• Were alterations, erasures, or other marks on the certificate of title?
• Were there previous owners that appear on the title?
• Was the car local, one owner vehicle or did an insurance company appears on the title meaning the car was wrecked or stolen and recovered as a total loss; or came from a recent hurricane or recent tornado area where thousand of vehicles were damaged.
Because “the brothers” refuse to discuss the resolution of this matter, the buyer will picket the dealership on Monday and possibly Tuesday to bring attention to the abusive practices of “the brothers” of Car Country.
