Sgt Rock has been wrong every step of the way. None of his predictions has ever come to pass with Righthaven.

"Despite any such Copyright Assignment, Stephens Media
shall retain (and is hereby granted by Righthaven) an exclusive
license to Exploit the Stephens Media Assigned Copyrights for any
lawful purpose whatsoever and Righthaven shall have no right or
license to Exploit or participate in the receipt of royalties from
the Exploitation of the Stephens Media Assigned Copyrights
other than the right to proceeds in association with a Recovery.."

However in their court filings:

7. Righthaven is the owner of the copyright in and to the Work.

30. Righthaven holds the exclusive right to reproduce the Work, pursuant to 17

31. Righthaven holds the exclusive right to prepare derivative works based upon the
Work, pursuant to 17 U.S.C. 106(2).

32. Righthaven holds the exclusive right to distribute copies of the Work, pursuant to
17 U.S.C. 106(3).

33. Righthaven holds the exclusive right to publicly display the Work, pursuant to 17

Righthaven could have just represented Stevens Media like a legitimate law firm but Stevens Media did not want all the bad publicity associated with it so they devised this scheme to allow Righthaven to merely claim copyright ownership. The problem is that Righthaven has perjured themselves on every court filing claiming they are the owners of the copyright as well as falsely filed themselves as the copyright owners with the US copyright office. This needs to be investigated in the criminal courts because this smacks of fraud.

This is the smoking gun. Stevens Media and Righthaven have entered into an illegal arrangement. This should not only close every case but require Righthaven to refund every penny in settlements and then some. Righthaven is about to be sued out of existence. Righthaven is finished and there is a good chance Gibson along with some Stevens Media executives will face criminal charges as well.

Righthaven didn't even bother disputing the Judge striking the original document, instead they refiled a new document with the same offending material. This Judge would be well within his rights to cite them with contempt of court.

Righthaven is now grasping at straws. Do they want to get spanked by Judge Kane again. They seem to forget Judge Kane is handling ALL cases in Colorado.

The rant they sent to the judge was unprofessional with a whining tone. These RIghthaven lawyers are not good at litigating. Then again if they were any good they would be working for a legitimate lawfirm.

We are all thrilled that Brian's case has been dropped. This is a humiliating defeat for Righthaven. This case will impact other cases in Colorado. The judge has indicated he will not be used by Righthaven for their profiteering.

Now lets hope Righthaven gets slapped with all of David Kerr's legal fees. He deserves every penny. Hopefully the good judge will also slap Righthaven with sanctions.

The fact that Righthaven is scraping the bottom of the barrel for copyrights shows they are in serious trouble. All they can get now is porn movies. They have not acquired any new copyrights from either the RJ or Denver Post or any other newspapers for several months now. This may indicate the papers have already cut them loose and that Righthaven is forced to look elsewhere for new copyrights.

One of the most egregious of cultural theft is being perpetrated by Disney with the movie "Song of the South". For racist reasons they have decided to ban the movie as a means to destroy African-American history and folklore. Now those stories are being hidden and suppressed.

The first African-American to ever win an oscar was the portrayal of Uncle Remis. Now the only way that movie is being preserved is by illegal means. That movie should have been put in the public domain years ago but because of culture thieves like Disney it may never be released legally again and a part of black history will be erased. The KKK would be proud.

Chunky

I may start calling Rock 'The Fireman' from Fahrenheit 451. That was a book about book burning. Our current copyright laws are like a giant bon fire that will consume almost all works ever created. This is exactly what will happen if Rock and his ilk get their way.

I wish we did not have to give the Fireman (Rock) a forum but he does serve a purpose. He actually brings more people to our side of thinking than his own. One thing certain about IP Maximilists is they will eventually be the catalyst for change because of their over-reaching. It will result in less copyright protection, not more.

That's what Ken thinks.
