The court says the US Marshals can use "reasonable force". Water-boarding sounds reasonable to me.

The Randazza Group will seize the very copyrights Righthaven claims to own. Stephens Media may lose the copyrights to the works they sought to protect by coming up with this scheme with Righthaven.

Wouldn't it be interesting if Randazza sues Stephens Media for copyright infringement over the works?

We also need to thank Brian Hill for fighting back. He brought his case to the press like none other and caused the Denver Post and Media News a lot of embarrassment which lead to them severing ties with Righthaven.

Righthaven is the gift that keeps on giving. They are just digging an ever deeper hole for themselves and the appeals courts are not coming to their rescue.

A jury trail would be Righthaven's worst nightmare. It wouldn't surprise me if they move to dismiss the case before that happened. Of course even that will present problems for Righthaven.

They say they are strapped for cash but can still pay for expensive appeals and high priced lawyers. Could the Stephens or some other entity bankrolling the appeals? Seems like something the Randazza's should investigate.

Righthaven says they cannot post a bond for the 34,000 they owe because they only have enough capitol for everyday operating experiences. If that's the case then how can they afford all these appeals and high priced lawyers?

Judge Kane's order also does not include any claims of fair use and lays out the Constitutional and historical relevancy to copyrights. This was a well thought out decision. So iron clad that if the appeals court upholds it, which is likely, it could be a benchmark case for all copyrights. The fact that their is a public interest in copyrights and it is not simply for the sole economic benefit of the creator or copyright holder. Righthaven would be foolish to appeal this one because of the potential precedent set by this case.

Funny how Righthaven says they are on the verge of bankruptcy and can't afford to pay the legal fees, however they can afford these expensive appeals and their high priced New York attorney Dale Cendali.
