Looks like the new revised Righthaven/Stephens Media agreement isn't holding any water either. Judges see right through it.
SOPA and PIPA have opened up the tech industrie's eyes to politics. Too long have we been content with just producing and letting others decide policies that effect our industry. The tech industry has matured to a state where we will decide our own destinies and not allow old legacy industries to do it for us.
Gibson and these attorneys may be publicly downplaying this but privately they have to be soiling their shorts over this. Even if it does not lead to disbarment just having an inquiry on their records will dog their professional careers for many years to come.
Steve Gibson has contended that he was confident the Appeals Courts would reverse their adverse rulings and put Righthaven back in the business of suing cat ladies and mildly autistic bloggers. Seems like that was yet another gross miscalculation on Gibson's part. Kind of like his dreams of "quadrillions" in law-suit awards.
Once Randazza gets a hold of Righthaven's trademarks they could sue Righthaven for trademark infringement if they continue to use the name Righthaven.

I disagree as far as pressing the copyrights. It is already weakening Righthaven's position on their appeals because they are having to argue they never had the copyrights in the first place at the same time arguing to have the earlier rulings reversed. Their entire defense is a contradiction.
I do agree that Stephens Media should be hauled in along with Gibson. They are just as culpable as he is.

You know I did not come across the Las Vegas Sun because I thought gee I would like to know what is happening in Las Vegas. I first came in contact with the Las Vegas Sun because another blog had copied parts of a Sun article about Righthaven and I wanted more info so I went to the Source and now I am a Sun reader and now a Vegas Inc reader even though I do not live in Las Vegas.
No study has ever been able to show that cut and pasting articles from newspapers keeps people from visiting the source who otherwise would have. Infact the opposite is true. Newspapers enjoy far more readership and not just in their markets because other sites link to their pages. It is also common knowledge among SEO experts that a simple link is ineffective and does not drive people to the source however having enough of the actual article to get people interested along with the link is extremely effective.
These newspapers and Righthaven took advantage of how news is dissemination over the internet and the time honored marketing tool of word of mouth promotion.
I'm not sure about the ruling about copying a full article because it really isn't necessary to copy an entire article to get the point across. However I would like to see the court address the issue of an implied licence.
