Look at the column Rock he has three instances where he links to posts from gametimeip and then posts portions of the contents of those posts. Just look at the column.

Oh you mean like your friend Sherman Frederick who's latest column
"Content protection -- Night of the unthinking commentator" featured substantial portions of words lifted from the blog gametimeIP.com?

Frederick cut and pasted portions of three posts from that blog and there is no indication Frederick got permission from gametimeIP.com. Sherman also gave no atribution to the blog owner except for a link and did not even enclose the portions he lifted in quotes leading the reader to possibly think those are Frederick's words and not from gametimeIP.

Frederick may very well be within fair use but any cut and pasting on his part is extremely hypocritical because he has called many who have done the same to be "content thieves" and would, given his way, not allow a single word to be copied and fair use be damned.

Sgt Rock, I fully expect you to defend Frederick's actions and justify what he has done but to do so will also put you squarely in the hypocrite column since you too have called people thieves for doing what Frederick has done.

Justify away.

I would be happy to take the drive down to Las Vegas to attend the criminal trial of Steve Gibson. One can only hope.

It appears that Gibson and his band of misfit layers are in complete denial mode about the predicament they are in. Gibson is still spouting off how they plan to continue filing lawsuits and there is no doubt about there standing even though Judge Hunt said in his ruling that the changes Righthaven and Stephens Media made were merely cosmetic. Being sanctioned by the court may be the easy part. Disbarment and ultimately prosecuted for fraud and/or other criminal charges is looking more and more likely.

WIred has a story that shows a very defiant Steve Gibson. Says he may refile lawsuits vacated over standing.

Gibson is being very defiant at a bad time when the Judge is considering sanctions. I don't think threatening people is a good way to impress the judge.

Agreements based on fraud are invalid. Those who settled already can challenge the settlements but the same reason many of them settled, lack of money to mount a defense, could also make it difficult for them to challenge the settlements. It is now time for some enterprising lawyers to come to the defense of these people and go after Righthaven, Stephens Media and Media Newsgroup.

I read the ruling in its entirety also and it is amazing how Judge Hunt absolutely destroys all of Righthaven's arguments. This was very well written and will be a hallmark case for all Righthaven cases going forward. It also opens the door wide open to hold Stephens Media ultimately responsible for this. Once Righthaven is gone It will be Stephens Media holding the bag for this.

Stephens Media created Righthaven for the purpose of distancing themselves and protecting themselves from liability but they are going to find it did not and they will end up losing far more than any "infringements" of their content ever could. Same goes for News Media group who will also be unable to escape from this. As media organizations they have severely breached the public trust and now they will reap the whirlwind.

Yes the entire thing was so underhanded that it offended the courts it offended everyone's sense of justice except for people like Sgt Rock and Sherman Frederick who now have to justify why they supported such a corrupt organization.

With sanctions a possibility hopefully this will get the Nevada bar as well as the Nevada State Atty General to take notice. Righthaven should not just be looked at civilly but criminally as well.

Yeah I agree with that one case but I would like to see judges rule on some of these fair use points because fair use is still on very hazy legal ground and some definitive rulings could have clarified for people what is permissible and what is not.

As far as those who have settled I think they now have even more ability to challenge the settlements. I think many will, however so many settled because they did not have money to fight. Hopefully these rulings will inspire more lawyers to take on these cases. With the prospect of getting money from Righthaven as well as Stephens Media and News Media Group it may be more enticing for lawyers to take them on.
